Welcome to Events de Luxe (“we,” “us,” or “our”). In partnership with our messaging service provider SpotHopper, we offer a mobile messaging program (the “Program”). By opting in or participating in this Program, you agree to the following Terms and Conditions (“Program Terms”).

These Terms apply specifically to the SMS messaging Program and do not replace any other agreements between you and Events de Luxe.

1. Consent to Receive Messages

By enrolling in our SMS Program, you agree to receive text messages from Events de Luxe and SpotHopper at the phone number you provide.

These messages may include:

• Event updates
• Promotions and special offers
• Service-related notifications

Messages may be sent using automated technology. Consent to receive messages is not required to make a purchase.

Standard message and data rates may apply.

2. Opt-Out Instructions

You may opt out of the Program at any time by replying:

STOP

After opting out:

• You may receive a confirmation message
• Processing may take a short time

This is the only valid method of opting out. Requests made through other means (e.g., verbally or via email) will not be considered valid.

3. User Responsibilities & Indemnification

If you change, transfer, or deactivate your phone number, you must opt out before doing so.

Failure to notify us may result in liability for:

• Claims
• Damages
• Legal fees

You agree to indemnify and hold harmless Events de Luxe and SpotHopper from any claims arising from failure to comply with this requirement.

4. Program Description

Participants can expect to receive recurring messages related to:

• Upcoming events
• Products and services
• Exclusive promotions

Message frequency may vary based on your interaction with the Program.

5. Costs and Charges

• Message and data rates may apply depending on your mobile carrier
• Recurring messages will be sent periodically

Note: Email support cannot be used to opt out of the Program.

7. Disclaimer of Warranty

The Program is provided “as is” and may not be available at all times or in all areas.

We are not responsible for:

• Carrier-related issues

Delivery depends on your mobile service provider and is outside our control.

8. Eligibility Requirements

To participate, you must:

• Own a mobile device capable of SMS messaging
• Be subscribed to a participating wireless carrier
• Have an active text messaging service

9. Age Restrictions

• Users under 13 years old are not permitted to use the Program
• Users aged 13–18 must have parental or guardian consent

By participating, you confirm that you meet these requirements.

10. Prohibited Content

You agree not to send or transmit content that is:

• Illegal, fraudulent, or misleading
• Offensive, abusive, or discriminatory
• Harmful (including malware or viruses)
• In violation of privacy or health data laws (e.g., HIPAA)
• Restricted by applicable laws

11. Dispute Resolution

Any disputes related to the Program will be resolved through:

• Binding individual arbitration, or
• Small claims court (if applicable)

• No class actions or group claims permitted
• Arbitration decisions are final and binding
• Each party bears its own costs unless otherwise determined

12. Changes to Terms

We reserve the right to update or modify these Terms at any time.

• Updates will be communicated where appropriate
• Continued participation in the Program constitutes acceptance of updated Terms

13. Miscellaneous

• These Terms constitute a legally binding agreement
• If any provision is found invalid, the remaining provisions remain enforceable
• Failure to enforce any right does not waive that right
